1 INTERPRETATION
A. DEFINITIONS
Bet
The fixed odds wager offered by Vernons to Customers whereby the Customer selects 2, 3, 4 or 5 numbers between 1 and 49 and if those numbers are matched by the numbers selected in the Draw then Vernons will pay the Customer Winnings as stated at the Means of Entry at the time the Bet was placed. The definitive Bet is that held by Vernons and not any service provider.
Bonus Ball(s)
The number(s) chosen by Customers to make up a total selection of 6 numbers from their 2, 3, 4 or 5 number selections which, if all matched in the Draw, will entitle the Customer to (a share of) the £1m Prize. No Stake is required to be paid for these Bonus Balls, but they can only be chosen to make a total of 6 with the 2, 3, 4 or 5 numbers of a valid Bet. There is a Free Route Entry to the £1m Prize Promotion which can only be entered in writing by post.
Customer
Any person aged 18 years or older or any group, partnership or syndicate of persons aged 18 or older and resident in the United Kingdom who places a Bet.
Draw
The first 6 numbers between 1 and 49 inclusive drawn by "49's" in their lunchtime Draw on such days as Vernons may choose, at or immediately after 1300 hours. If for any reason a Draw does not take place, then the Customer's Stake will be refunded. The 7th number drawn ("the Booster" "Bonus Ball" "Extra" etc) or any other additional number(s) does not count for the purposes of this game.
Free Route Entry
A Free Entry into the £1m Prize Promotion without entering the 49's or any other Vernons' game, competition or promotion and where no Stake is payable.
Means of Entry
In writing, by telephone, by electronic or digital communication by the Internet or such other means of transmission and receipt as Vernons shall choose to accept. Any written entry must be clearly legible in blue or black ink and will be disqualified if, in Vernons opinion, it is unclear or capable of more than one interpretation. Vernons reserves the right to record all telephone entries, the copyright in such recordings belonging to Vernons.
Stake
The sum of money paid to Vernons by the Customer for application to the Bet.

Vernons Dispute Resolution Process
The formal procedure set up by Vernons to deal with Customer disputes, a copy of which can be found on the Website or obtained from Vernons by post.

Winnings
The sum of money paid by Vernons to a Customer whose selection of numbers matches the drawn numbers calculated in accordance with the odds quoted at the Means of Entry. Winnings will be paid by cheque posted to the Customer's last known address.
49s
49's Limited of 7A Great Queen Street, Holborn, London, WC2B 5BG, the operator of the 49's games whose Draws are used for the purposes of the 49's Bet whose published results are binding on both Vernons and Customers. The drawn numbers are displayed in most Licensed Betting Offices, on the Website, on Teletext page 614 and by telephone on 0800 781 7500.
£1m Prize Promotion
The sum of £1,000,000 will become payable or be paid by equal instalments of £40,000 annually (on a date chosen by Vernons and without interest) for 25 years by Vernons to the Customer (or shared equally between Customers) whose selection of 6 numbers matches the 6 numbers in the relevant Draw. The £1m Prize instalments will only be paid annually by cheque posted to the Customer's last known address. The payments will cease on the death of the Winning Customer(s) and thereafter no instalments will become payable or be paid.
B. GENERAL
- The Laws of England and Wales apply to these Rules and to all Bets placed under them.
- No one under the age of 18 years is allowed to enter any Vernons game or competition and Vernons reserves the right to use such checks as it may deem appropriate on a random or selective basis at any time.
- If age cannot be verified then any Bet entered will be declared void and the Stake returned to the Customer's last known address in the form of a cheque.
- Payment of Winnings will be suspended until such time as Vernons is satisfied that the Customer is 18 years of age or older.
- These Rules apply to Vernons 49's Bets and take precedence, in the event of conflict, over any other Vernons FairPlay Rules.
- Vernons reserves the right to alter these Rules and/or to alter the odds offered at any time and to notify such alteration(s) by such means as Vernons considers appropriate.
- Vernons reserves the absolute right to withdraw this game or any part of it, namely any one of the numbers Bets and will Refund all Stakes paid in advance.
- If, in the opinion of Vernons, it is not reasonably practicable to complete any one or more of the 49's games or Vernons or 49's business has been affected by:- fire, explosion, action of the elements, failure of machinery of any description, congestion on the Internet or Website, damage or malfunction of telephone or computer equipment by virus, tampering, hacking or unauthorised intervention, industrial dispute whether inside or outside Vernons or 49's, interruption of mains services, civil disorder, Act of God or any event of similar nature or effect then Vernons may exercise its discretion to declare any or all Bets void and all Stakes paid will be Refunded.
- The Customer must ensure compliance with laws which may affect him or her on the basis of residence and must pay any tax or levy raised in any such jurisdiction on any Winnings. Vernons takes no responsibility for the legality of any of its competitions outside the United Kingdom or the lawfulness of any Customer's participation therein and the Customer will indemnify Vernons against any claims made as a result of the Customer's action.
- Save the £1m Prize (or any part thereof) the maximum amount which will be paid to any Customer or to any one source will be £100,001.
- Vernons will not be held responsible for any damage or problem with any telephone or computer equipment, howsoever arising, as a result of any Customer's participation in the Game or downloading any information from the Website.
2 APPLICATION OF THESE RULES
A. HOW TO BET
- A Customer selects 2, 3, 4 or 5 numbers (and, if he/she wishes to enter the £1m Prize competition, 4, 3, 2 or 1 further differently numbered Bonus Balls) notifying them to Vernons by an approved Means of Entry and paying a Stake. In the 2, 3, 4 and 5 number Bets, if each number forecast is matched from the first 6 numbers drawn in the Draw, then Vernons will pay to the Customer Winnings calculated as stated at the Means of Entry at the time the Bet was placed. If all 6 numbers are so matched, the Customer will be entitled to (a share in) the £1m Prize (equally divided between all Customers whose 6 numbers match those drawn). No Winnings will be paid to Customers who have won (a share in) the £1m Prize.
- All Bets must be made and received by Vernons before 12.00 hours or 15 minutes (whichever is the earlier) before the Draw takes place. Vernons reserves the right to enter any Bet received after that time into the next Draw. Any Bet received by Vernons by post less than 12 hours before the Draw will not be entered into that Draw but will be entered in the next available Draw. Vernons stamp on the coupon shall be the definitive time/date of receipt.
- Vernons may refuse to accept any Bet and Vernons decision shall be final. For the avoidance of doubt a Bet will be disqualified and no claim for Winnings will be entertained by Vernons where:-
- a Bet is made by a person under the age of 18 years;
- it does not reach Vernons in accordance with these Rules;
- a Bet made by a person who is not a resident of the United Kingdom;
- it is made by or on behalf of an employee, agent or assignee of Vernons, its advertising agencies or any promotional companies involved in 49's or family or household members of such persons;
- payment on the Customer's debit or credit card is refused or revoked;
- a Bet is lost, interrupted or affected by the non-availability or malfunction of any server or other form of connection;
- a Bet which appears to be jumbled, scrambled or misdirected by any kind of electronic or mechanical failure;
- the loss of any Bet or part thereof, howsoever caused.
B. CONDITIONS
- Customers are not allowed to attend Vernons premises in person or to supply any Stake in cash or otherwise than by cheque, debit or credit card.
- Any Winnings paid on a void or disqualified Bet shall forthwith be repaid by the Customer to Vernons.
- No Winnings will be paid until the Customer has satisfied all Vernons security requirements, including satisfactory proof of identity and completion of such forms or affidavits as Vernons may require.
- Vernons will publish any minimum or maximum Stake and the minimum or maximum number of Draws for which Bets can be accepted at the Means of Entry.
- If for any reason an incorrect stake is received by Vernons it may at its discretion reject the Bet or accept any underpaid stake and adjust the Winnings accordingly.
- For the avoidance of doubt, Vernons will accept a bet wherein the Customer has proferred one half of the minimum stake on both of two selections (thereby making one minimum Stake) and will pay Winnings based on that half stake. Similarly, if on such a Bet the Customer becomes entitled to (a share in) the £1m Prize, he will only be entitled to (a share of) one half of the £1m Prize.
- A Free Route Entry can only be made as follows:-
- By writing on a piece of plain paper in blue or black ink:
- "49's Free Route Entry for [the date of the Draw for which the Free Route Entry is made]" and
- 6 numbers between 1 and 49 inclusive, and
- his/her name, address, postcode and daytime telephone number.
- Sending the Free Route Entry by post to Vernons 49's, Free Route Entry, Fortune House, Liverpool L68 1AA to arrive not later than 24 hour(s) before the Draw for which the Free Route Entry specifies. Any Free Route Entry received by Vernons less than 24 hours before that Draw will be void;
- Only one Free Route Entry will be allowed to each person for each Draw and is only valid for the specified Draw and numbers will not be carried into any other Draw.
- Any Entry which Vernons considers illegible shall be void.
- If a Customer fails to choose Bonus Ball(s) Vernons may complete the Bet on the Customer's behalf, but is under no obligation so to do and accepts no liability.
- Vernons will check the results and notify the Customer of any Winnings. Should any Customer believe he/she has a claim this must be notified to Vernons as soon as possible and the Customer shall provide evidence of the Entry and Stake and any other information requested by Vernons whose decision with regard to any Winnings shall be final. No claim will be accepted if made more than 6 months after the relevant Draw.
Fair Play Rules

1 INTERPRETATION

Draw
The first 6 numbers between 1 and 49 drawn by "49s" in their lunchtime Draw at or immediately after 1300 hours on such days as Vernons may choose. The 7th number drawn (the "Booster" "Bonus Ball" "Extra" etc), or any other additional number does not count for the purposes of Pick 6 or any other Vernons game.
Entry
The 6 numbers between 1 and 49 selected by the Customer and notified to Vernons which, if matched by the numbers selected in the particular Draw, will result in Vernons paying the Customer (subject to Rule 2.A.9 below) the Prize. The definitive Entry is that held by Vernons for which purpose any service provider is not included.
Means of Entry
Electronic or digital communication or such other means of transmission and receipt as Vernons shall choose to accept. No bet will be accepted by way of facsimile or by post, or in any written form.
Pick 6
The free to enter Promotion, whereby Vernons will pay the Prize to the Customer(s) whose 6 selected numbers match the first 6 numbers drawn in the relevant Draw. This Promotion is available without placing a Bet or making any payment to or by direction of Vernons.
The Prize

- The Customer must ensure compliance with laws which may affect him or her and must pay any tax or levy raised in any jurisdiction on the Prize. Vernons takes no responsibility for the legality of any of its promotions, games or competitions outside the United Kingdom or the lawfulness of any Customer's participation therein and the Customer will indemnify Vernons against any claims made as a result of the Customer's action.
- The maximum amount which will be paid to any Customer or to any one source, or to any number of Customers under Rule 2.A.9 is £1,000,000.
- If, due to the failure or malfunction of any telephone equipment, computer, website operator, service provider, server or other method of communication, any Entry or other required information is not in the possession of the Insurer before the Draw, then Vernons has the discretion to declare any, or all, of the Entries void and in these circumstances Vernons will pay no Prize.
- Vernons will not be held responsible for any damage or problem with any telephone or computer equipment, howsoever arising, as a result of any Customer's participation in Pick 6 or downloading any information from the Website.
- Any dispute will be dealt with by the Vernons Dispute Resolution Process, details of which can be obtained from Vernons by post or on the Website.
2 APPLICATION OF THESE RULES
A. HOW TO ENTER
- A Customer chooses six numbers between 1 and 49 inclusive for any one Draw, notifying them to Vernons by an approved Means of Entry. If each number forecast is matched in the Draw, Vernons will pay the Prize to the Customer.
- All Entries must be made and received by Vernons before noon or sixty minutes before the Draw takes place, whichever is the earlier. Any Entry received after that time will be entered in the next Draw.
- Vernons has discretion to refuse to accept any Entry and Vernons decision shall be final. For the avoidance of doubt an Entry will be disqualified and no claim for the Prize will be entertained by Vernons where:-
- an Entry is made by a person under the age of 18 years;
- any Entry made by a Customer who is not a resident of the United Kingdom;
- it does not reach Vernons in accordance with these Rules;
- it is made by or on behalf of an employee, agent, successor or assignee of Vernons, its advertising agencies or any promotional companies or family or household members of such persons;
- payment on the Customer's debit or credit card is refused or revoked in connection with an associated Entry or Bet with Vernons.
- a bet is lost, interrupted or affected by the non-availability or malfunction of any server or other form of connection;
- a bet which appears to be jumbled, scrambled or misdirected by any kind of electronic or mechanical failure;
- the loss of any bet or part thereof, howsoever caused.
- Customers are not allowed to attend Vernons premises in person or to enter by any way than the Means of Entry.
- Any Prize paid on a void or disqualified Entry shall forthwith be repaid by the Customer to Vernons.
- Vernons will use reasonable endeavours to ensure that there is no duplication of the sets of six numbers allowed in any one Draw and will notify any Customer who chooses a group of six numbers which has already been entered in the relevant Draw so that the Customer could choose different numbers or a random selection (lucky dip).
- Vernons Pick 6 to Win £1 Million Promotion is available free of charge to any person who wishes to enter. Vernons reserves the right to allow Customers playing other Vernons games to enter the competition without charge as part of the same Promotion. For any person entering without having played any other Vernons game, this Promotion is limited to one Entry per Customer, per Draw. Vernons will disqualify all second or subsequent Entries.
- To enable the Prize to be paid, all Customers must, on each Entry, supply such registration details and such information as Vernons may require. No Prize will be paid unless the Customer satisfies all Vernons security requirements, including completion of affidavits and proof of identity. No Prize will be paid to any Customer who is not a UK resident.
- In the event of two or more Entries of the same numbers being accepted by Vernons, then Customers whose choice of numbers match the numbers drawn, will share the Prize with all other Customers who have chosen the same numbers.
- The Winner(s) of the Prize will complete such documentation as Vernons requires and allow his/her/their identities and likenesses to be used in promotional material and without the need for further permission or compensation as a condition precedent of receiving the Prize.
- The onus is on the Customer to satisfy Vernons of his/her entitlement to the Prize. Vernons will normally notify the Customer that he/she has won the Prize, but if the Customer has not been notified by Vernons within seven days of the draw, then the Customer must claim in writing or by electronic mail giving all such detail as Vernons requires. No claim will be accepted or Prize awarded more than twenty-eight days after the Draw.
