GB Lotto FairPlay Rules
Effective September 2007
1 INTERPRETATION
A. DEFINITIONS
Bet
A Fixed Odds Wager offered by Vernons where the Customer selects 5 numbers between 1 and 50 in the First Draw and 2 numbers between 1 and 9 in the Star Draw and if the Customer's selection is matched in whole or in part by the numbers drawn in the First Draw and/or the Star Draw, then Vernons will pay the Customer Winnings as set out on the website.
Customer
Any person aged 18 years or older or any group, partnership, or syndicate of persons aged over 18 and resident in the United Kingdom who places a Bet.
First Draw
The first 5 numbers between 1 and 50 drawn in the New York State Mega Millions Game played on Friday evening (New York time) each week. If numbers 51 to 56 are drawn, then the numbers below 50 will stand and the replacement number(s) taken from the Florida Lotto Draw made on the following Saturday evening (Florida time) being the first non-duplicated numbers below 50. If this procedure does not produce 5 numbers below 50 then the remaining number(s) will be taken from the following Tuesday draw in the New York State Mega Millions Game (and so on to the following Wednesday Florida Lotto Draw and on to the following Friday draw of the New York State Mega Millions Game) until 5 non-duplicated numbers below 50 have been drawn.
Florida State Lottery
The operator of the Florida Lotto used for the purposes of this Game, whose address is www.flalottery.com
Game
Vernons GB Lotto.
Insurer
The body or bodies with which Vernons has contracted from time to time to supply funds for the prize.
Means of Entry
Electronic or digital communication via the Internet or such other means of transmission and receipt as Vernons shall choose to accept. Any Bet in writing must be in a form acceptable to Vernons and any Bet placed by telephone may be recorded and the recording will remain the property of Vernons. No Bet will be accepted by facsimile.
New York State Lottery
The operator of the First Draw and the Star Draw used for the purposes of this Game, whose address is www.nylottery.org.
Refund
The return of part or all of a Stake to the Customer's Vernons account.
Stake
The sum of money paid to Vernons by the Customer for application to the Bet. Vernons reserves the right to vary the maximum and minimum Stake from time to time notifying such changes at or on the Means of Entry.
Star Draw
The first 2 different numbers between 1 and 9 drawn in the New York State Lottery "Win4" game played at or shortly after mid-day on the Saturday following the First Draw (New York time); if 2 different numbers between 1 and 9 are not drawn in that Star Draw, the remaining required number will be the first different number drawn in the following "Win4" game (and so on until 2 different numbers between 1 and 9 have been drawn). For the avoidance of doubt, zero does not count as a number for this Game.

Vernons Dispute Resolution Process
The formal procedure set up by Vernons to deal with Customer disputes, a copy of which can be found on the Website or obtained from Vernons by post.
Website
Winnings
The sum of money paid by Vernons to a Customer whose selected numbers are matched in part or in whole by the numbers drawn in the First Draw and the Star Draw, calculated by multiplying the Stake by the odds set out on the Website. Winnings can only be paid by crediting the Customer's Vernons' account or by cheque to his/her last known address.
B. GENERAL
- The laws of England and Wales apply to these Rules and to all Bets made under them.
- No one under the age of 18 years is allowed to enter any Vernons game or competition and Vernons reserves the right to use such checks as it may deem appropriate on a random or selective basis at any time.
- If age cannot be verified then any Bet entered will be declared void and the Stake returned to the Customer's last known address in the form of a cheque.
- Payment of Winnings will be suspended until such time as Vernons is satisfied that the Customer is 18 years of age or older.
- These Rules apply to this Game and take precedence in the event of conflict with any other Vernons FairPlay Rules.
- Vernons reserves the right to alter these Rules and/or alter the odds offered at any time and to notify such alterations by such means as Vernons considers appropriate.
- Vernons reserves the right to withdraw the Game or any part of it and will Refund all Stakes paid in advance.
- If, in the opinion of Vernons, it is not reasonably practicable to complete any one or more of the Game's Draws or Vernons or the New York State or Florida State Lottery has been affected by:- fire, explosion, action of the elements, failure of machinery of any description, congestion on the Internet or Website, damage or malfunction of telephone or computer equipment by virus, tampering, hacking or unauthorised intervention, industrial dispute, whether inside or outside Vernons, the New York State Lottery or the Florida State Lottery, interruption of main services, civil disorder, Act of God or any event of similar nature or effect then Vernons may exercise its absolute discretion to declare any or all Bets void and all Stakes paid will be Refunded.
- The Customer must ensure compliance with laws which may affect him or her on the basis of residence and must pay any tax or levy raised in any jurisdiction on any Winnings. Vernons takes no responsibility for the legality of its promotions, games or competitions outside the United Kingdom or the lawfulness of any Customer's participation therein and the Customer will indemnify Vernons against any claims made as a result of the Customer's action.
- The maximum amount of Winnings paid to any one Customer is £1 million in any one Draw.
- Vernons reserves the right to pay the £1 million by equal annual instalments of £40,000, without interest, and,
- For the avoidance of doubt Winnings will only be paid at one level on any one bet and that will be the highest level which the Draws allow.
- Vernons will not be held responsible for any damage or any problem with any telephone or computer equipment, howsoever arising, as a result of any Customer's participation in the Game or downloading any information from the Website.
- Vernons will not pay any Winnings against incorrectly announced, broadcast or otherwise disseminated information but only against the official results provided by the New York and the Florida State Lotteries and published on their Websites.
- Any dispute will be dealt with by the Vernons Dispute Resolution Process, details of which can be obtained from Vernons by post or on the Website.
2. APPLICATION OF THESE RULES
- A Customer chooses 5 numbers in the First Draw and 2 numbers in the Star Draw and if matched in part or in whole, Vernons will pay the Customer Winnings as shown on the Website.
- All Bets must be received by Vernons before the midnight (U.K. time) immediately preceding the First Draw; Bets received after that time will be entered into the next First and Star Draws.
- Vernons may refuse to accept any Bet and Vernons decision shall be final. For the avoidance of doubt a Bet will be disqualified and no claim for Winnings will be entertained by Vernons where:-
- a Bet is made by a person under the age of 18 years;
- a Bet is made by a Customer who is not a resident of the United Kingdom;
- a Bet does not reach Vernons in accordance with these Rules;
- a Bet is made by or on behalf of an employee, agent, successor or assignee of Vernons, its advertising agencies or any promotional companies involved in the Game or the family or household members of any such persons;
- payment on the Customer's debit or credit card is refused or revoked in connection with an associated entry or bet with Vernons;
- a Bet is lost, interrupted or affected by the non-availability or malfunction of any server or other form of connection;
- a Bet which appears to be jumbled, scrambled or misdirected by any kind of electronic or mechanical failure;
- the loss of any Bet or part thereof, howsoever caused.
- Customers are not allowed to attend Vernons premises in person or to enter by any way than the Means of Entry.
- Any Winnings paid on a void or disqualified Bet shall forthwith be repaid by the Customer to Vernons.
- If for any reason an incorrect Stake is received by Vernons it may at its discretion reject the Bet or accept any underpaid Stake and adjust the Winnings accordingly.
- No Winnings shall be paid until the Customer has satisfied all Vernons security requirements including satisfactory proof of identity in completion of such forms or affidavits as Vernons may require.
- Vernons will publish any minimum or maximum Stake and the minimum and maximum number of Draws for which Bets can be accepted at the Means of Entry.
- The onus is on the Customer to satisfy Vernons of his/her entitlement to the Winnings. Vernons will normally notify the Customer that he/she has Winnings, but if the Customer has not been notified by Vernons within seven days of the Draw, then the Customer must claim in writing or by electronic mail giving such details as Vernons requires. No claim will be accepted or the Winnings paid more than 28 days after the Draw.
- Vernons will use its best endeavours to prevent more than one Customer betting on a selection of 5 numbers in the First Draw. The Customer who chooses a set of 5 numbers already selected for a Bet will be asked to choose differently or accept a random selection ("lucky dip").
