1 INTERPRETATION
A. DEFINITIONS
Bet
The fixed odds wager offered by Vernons to Customers whereby the Customer selects 2, 3, 4 or 5 numbers between 1 and 49 and if those numbers are matched by the numbers selected in the Draw then Vernons will pay the Customer Winnings as stated at the Means of Entry at the time the Bet was placed. The definitive Bet is that held by Vernons and not any service provider.
Customer
Any person aged 18 years or older or any group, partnership or syndicate of persons aged 18 or older and resident in the United Kingdom who places a Bet.
Draw
The first 6 numbers between 1 and 49 inclusive drawn by "49's" in their lunchtime Draw on such days as Vernons may choose, at or immediately after 1300 hours. If for any reason a Draw does not take place, then the Customer's Stake will be refunded. The 7th number drawn ("the Booster" "Bonus Ball" "Extra" etc) or any other additional number(s) does not count for the purposes of this game.
Means of Entry
In writing, by telephone, by electronic or digital communication by the Internet or such other means of transmission and receipt as Vernons shall in its discretion choose to accept. Any written entry must be clearly legible in blue or black ink and will be disqualified if, in Vernons opinion, it is unclear or capable of more than one interpretation. Vernons reserves the right to record all telephone entries, the copyright in such recordings belonging to Vernons.
Money Back Ball
A number chosen by the Customer which, if drawn in the Draw, will entitle the Customer to a credit equal to his Stake which can only be used as (part of) a Stake in a further Bet. This number cannot be the same number as of a Bet but no Stake is required. For the avoidance of doubt, any Winnings will comprise the Stake and if Winnings are paid and the Money Back Ball was drawn, the Customer will receive the credit but no cash equivalent and the credit can only be spent in a further Bet.
Stake
The sum of money paid to Vernons by the Customer for application to the Bet.

The formal procedure set up by Vernons to deal with Customer disputes, a copy of which can be found on the Website or obtained from Vernons by post.

Winnings
The sum of money paid by Vernons to a Customer whose selection of numbers matches the drawn numbers in accordance with the odds quoted at the Means of Entry. Winnings will be paid by cheque posted to the Customer's last known address..
49s
49's Limited of 7A Great Queen Street, Holborn, London, WC2B 5BG, the operator of the 49's games whose Draws are used for the purposes of the 49's Bet whose published results are binding on both Vernons and Customers. The drawn numbers are displayed in most Licensed Betting Offices, on the Website, on Teletext page 614 and by telephone on 0800 781 7500.
B. GENERAL
- The Laws of England and Wales apply to these Rules and to all Bets placed under them.
- No one under the age of 18 years is allowed to enter any Vernons game or competition and Vernons reserves the right to use such checks as it may deem appropriate on a random or selective basis at any time.
- If age cannot be verified then any Bet entered will be declared void and the Stake returned to the Customer's last known address in the form of a cheque.
- Payment of Winnings will be suspended until such time as Vernons is satisfied that the Customer is 18 years of age or older.
- These Rules apply to Vernons 49's Bets and take precedence, in the event of conflict, over any other Vernons FairPlay Rules.
- Vernons reserves the right to alter these Rules and/or to alter the odds offered at any time and to notify such alteration(s) by such means as Vernons considers appropriate.
- Vernons reserves the right to withdraw this game or any part of it, namely any one of the numbers Bets and will Refund all Stakes paid in advance.
- If, in the opinion of Vernons, it is not reasonably practicable to complete any one or more of the 49's games or Vernons or 49's business has been affected by:- fire, explosion, action of the elements, failure of machinery of any description, congestion on the Internet or Website, damage or malfunction of telephone or computer equipment by virus, tampering, hacking or unauthorised intervention, industrial dispute whether inside or outside Vernons or 49's, interruption of mains services, civil disorder, Act of God or any event of similar nature or effect then Vernons may exercise its discretion to declare any or all Bets void and all Stakes paid will be Refunded.
- The Customer must ensure compliance with laws which may affect him or her on the basis of residence and must pay any tax or levy raised in any such jurisdiction on any Winnings. Vernons takes no responsibility for the legality of any of its competitions outside the United Kingdom or the lawfulness of any Customer's participation therein and the Customer will indemnify Vernons against any claims made as a result of the Customer's action.
- The maximum amount which will be paid to any Customer or to any one source is £100,001.
- Vernons will not be held responsible for any damage or problem with any telephone or computer equipment, howsoever arising, as a result of any Customer's participation in the Game or downloading any information from the Website.
- Any dispute will be dealt with by the Vernons Dispute Resolution Process, details of which can be obtained from Vernons by post or on the Website.
2 APPLICATION OF THESE RULES
A. HOW TO BET
- A Customer chooses 2, 3, 4 or 5 numbers (plus a Money Back Ball) for any Draw notifying them to Vernons by an approved Means of Entry and paying a Stake. If each number forecast is matched from the first 6 numbers drawn in the Draw, Vernons will pay to the Customer Winnings in accordance with the odds stated at the Means of Entry at the time the Bet was placed, or refund the Stake if the Money Back Ball is selected and the Customer has no Winnings on the Bet.
- All Bets must be made and received by Vernons before 12.45 hours or fifteen minutes (whichever is the earlier) before the Draw takes place. Any Bet received after that time will be entered in the next Draw. Any Bet received by Vernons by post less than 24 hours before the Draw will not be entered into that Draw but will be entered in the next available Draw. Vernons stamp on the coupon shall be the definitive time/date of receipt.
- Vernons may refuse to accept any Bet and Vernons decision shall be final. For the avoidance of doubt a Bet will be disqualified and no claim for Winnings will be entertained by Vernons where:-
- a Bet is made by a person under the age of 18 years;
- it does not reach Vernons in accordance with these Rules;
- a Bet is made by a person who is not a resident of the United Kingdom;
- it is made by or on behalf of an employee, agent or assignee of Vernons, its advertising agencies or any promotional companies involved in 49's or family or household members of such persons;
- payment on the Customer's debit or credit card is refused or revoked;
- a Bet is lost, interrupted or affected by the non-availability or malfunction of any server or other form of connection;
- a Bet which appears to be jumbled, scrambled or misdirected by any kind of electronic or mechanical failure;
- the loss of any Bet or part thereof, howsoever caused.
- Customers are not allowed to attend Vernons premises in person or to supply any Stake in cash or otherwise than by cheque, debit or credit card.
- Any Winnings paid on a void or disqualified Bet shall forthwith be repaid by the Customer to Vernons.
- No Winnings will be paid until the Customer has satisfied all Vernons security requirements, including satisfactory proof of identity and completion of such forms or affidavits as Vernons may require.
- Vernons will publish any minimum or maximum Stake and the minimum or maximum number of Draws for which Bets can be accepted at the Means of Entry.
- If for any reason an incorrect stake is received by Vernons it may reject the Bet or accept any underpaid stake and adjust the Winnings accordingly.
- Vernons will check the results and notify the Customer of any Winnings. Should any Customer believe he/she has a claim this must be notified to Vernons as soon as possible and the Customer shall provide evidence of the Entry and Stake and any other information requested by Vernons whose decision with regard to any Winnings shall be final. No claim will be accepted if made more than 6 months after the relevant Draw.
